The Spring Gardens Waiver, Indemnification, and Agreement

  1. I acknowledge and agree that I am gardening at The Spring Gardens (“the Garden”) at my own risk and that I will not hold responsible (and hereby release) The Spring Gardens Inc. (“TSG”), Spring Garden Community Development Corporation (“SGCDC”), the City of Philadelphia (“City”), and each of their officers, Steering Committee members, Board members, employees, agents, representatives and volunteers, of and from any claims for injuries, losses, and/or damages, past or future (including from any hazardous substances) that may be suffered by me, my family members, guests, invitees, or any other individuals by reason of my/their use of or entry onto the Garden premises.

  2. I accept, on behalf of myself and my family members, guests, and invitees, the Garden premises in AS IS condition, and agree and understand that TSG, SGCDC, and the City (and their officers, Steering Committee members, Board members, employees, agents, representatives, and volunteers) make no representations, express or implied, as to the safety and condition of the Garden premises.

  3. I agree that I and my family members, guests, and invitees will not use the Garden for any for-profit commercial purposes (except as otherwise approved in writing by the above entities, in their sole discretion).

  4. I agree that I and my family members, guests, and invitees will not contaminate the Garden with any hazardous substances. We will not bring into the Garden or permit to be brought into or used in, and/or carried out in, any controlled substances, marijuana (even if legal), firearms, open fires, burning of trash, or dumping on or at The Garden. I agree that I and my family members, guests, and invitees will abide by all rules and regulations, as they may be promulgated from time to time, governing the use of the Garden by my family members, guests, and invitees, including the provisions of any lease of the Garden site, including the July 22, 2021 Lease, entered into between the City and SGCDC.

  5. I will indemnify and hold harmless TSG, SGCDC, the City, and their officers, Steering Committee members, Board members, employees, agents, representative and volunteers in the event of any breach of the foregoing by me, or on my behalf, or in the event of any breach by my family members, guests, or invitees.
